All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively "Content") is owned or licensed property of LakArcade or its suppliers or licensors and is protected by copyright, trademark, patent, or other proprietary rights. The collection, arrangement, and assembly of all content on the Site are the exclusive property of LakArcade and protected by national and international copyright laws. LakArcade and its suppliers and licensors expressly reserve all intellectual property rights in all Content.

License and Access

LakArcade grants you a limited license to access and make personal use of the Site and the Content for non-commercial purposes only, and only to the extent such use does not violate these Terms & Conditions, including the prohibitions listed below. You may download, print, and copy Content for personal, non-commercial purposes only, provided you do not modify or alter the Content in any way, delete or change any copyright or trademark notice, or otherwise violate these Terms & Conditions. Using the Site or its Content for any commercial purpose constitutes a material breach of these Terms & Conditions.

The Site is intended for use by individuals 13 years of age or older. If you are under 18, you may use this Site only with the involvement of a parent or guardian.

Unlawful or Prohibited Uses

The Site may only be used for lawful purposes in accordance with the license granted in these Terms & Conditions. As a condition of your use of this Site, whether on your own behalf or on behalf of any third party, you may not:

1. Make any commercial use of the Site or its Content, including collecting or using product listings, descriptions, prices, or images;
2. Download, copy, or transmit any Content for the benefit of any other merchant;

6. Use meta tags or hidden text utilizing LakArcade's name or marks;
7. Misrepresent your identity or affiliation with any person or entity in connection with the Site;
8. Use a buying agent to conduct transactions on the Site;
9. Conduct fraudulent activities on the Site;
10. Violate or attempt to violate the security of the Site, including unauthorized access, probing for vulnerabilities, spamming, or forging headers and communications;
11. Send unsolicited or unauthorized email on behalf of LakArcade;
12. Tamper with or interfere with the working or functionality of the Site;
13. Use the Site to defame, abuse, harass, stalk, or threaten others, or violate their legal rights;

15. Restrict or inhibit any other person's use of the Site, including by hacking or defacing it;
16. Advertise or offer to sell or buy goods or services on the Site without prior written consent;
17. Reproduce, duplicate, copy, sell, or exploit any part of the Site for commercial purposes;
18. Modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the Site; or
19. Remove any copyright, trademark, or proprietary rights notice from the Site or its materials.

Your Account

You may be required to register with LakArcade to access certain services or areas of the Site. We may refuse to grant the user name you request. Your user name and password are for your personal use only, and you are responsible for maintaining their confidentiality and for all activities that occur under your account. LakArcade reserves the right, in its sole discretion, to terminate your account, refuse service, or cancel orders.

Modification and Termination

LakArcade may at any time modify or discontinue any part of the Site, change or waive fees, or offer opportunities to some or all users. We reserve the right to update these Terms & Conditions at any time, effective immediately upon posting. Continued use of the Site indicates your acceptance of the current Terms & Conditions; however, material changes will not be applied retroactively to disputes that arose before the change.

LakArcade reserves the right, without notice and at its sole discretion, to terminate your account or access to the Site for any reason, or for no reason. We are not liable to you or any third party for such termination. Provisions intended to survive termination — including representations, warranties, limitations of liability, and indemnities — will continue to apply.

User Reviews, Comments, and Submissions

LakArcade welcomes reviews, comments, photos, videos, or other content you submit ("User Content"), provided it complies with these Terms & Conditions and our General Review Writing Guidelines. You agree that any User Content will be accurate, lawful, and free of content that infringes third-party rights or is obscene, threatening, harmful, or otherwise objectionable. You are solely responsible for your User Content, and LakArcade assumes no liability for it. We reserve the right, but have no obligation, to monitor, alter, remove, or refuse to post User Content, and to disclose it where necessary.

By submitting User Content, you grant LakArcade a non-exclusive, sub-licensable, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute that content in any form or medium, without compensation to you. Do not submit any content you do not wish to license to us, including confidential information or original creative work. You represent that you hold all rights necessary to grant this license, and you waive any moral rights relating to attribution or integrity of your User Content.

Content may also be posted by third-party visitors. LakArcade does not endorse and is not responsible for any third-party opinions, advice, or statements, and is not liable for any loss arising from reliance on such content.

Transactions

To purchase products or services through the Site ("Transaction"), you may be asked to provide payment and shipping details. You represent and warrant that you have the legal right to use any payment method submitted. By submitting this information, you grant LakArcade the right to share it with third parties to facilitate your Transaction, and verification may be required before a Transaction is acknowledged or completed.

All descriptions, images, prices, and specifications on the Site are subject to change without notice and may include approximate weights or measures. Availability of any product or service is not guaranteed. You are responsible for complying with all applicable laws regarding the receipt, possession, and use of any item purchased, and for ensuring it will be used lawfully. LakArcade reserves the right to limit quantities, impose conditions on promotions, bar any user from completing a Transaction, or refuse to provide any product or service. You agree to pay all charges incurred through the Site, including shipping and handling, and remain responsible for any applicable taxes.

Colors

LakArcade strives to display product colors as accurately as possible; however, we cannot guarantee that any monitor's display of color will be fully accurate.

Limitations on Quantity

LakArcade does not offer additional discounts on large orders of a single item or of many individual items. We reserve the right to limit quantities on orders placed by the same account, credit card, or billing/shipping address, and will notify you if such limits apply.

Availability, Errors, and Inaccuracies

If an item is out of stock, LakArcade may, at no extra cost to you, substitute another item of equal or greater value at its sole discretion. An order acknowledgement confirms that your request was received — not that it has been accepted, shipped, or that pricing and availability have been confirmed.

Despite our best efforts, some items may be mispriced, described inaccurately, or unavailable. We reserve the right to correct such errors at any time without prior notice. We verify price and availability before shipping: if the correct price is lower, we charge the lower amount; if higher, unavailable, or otherwise inaccurate, we will cancel the order and notify you by email. Risk of Loss

Except as otherwise stated, risk of loss for and title to products purchased on the Site passes to the purchaser upon delivery to the carrier.

We may provide links to third-party websites or services containing financial or other information as a convenience. LakArcade does not monitor, endorse, or assume responsibility for the accuracy or completeness of such third-party content.

LakArcade does not warrant the accuracy or completeness of nutrition, ingredient, or allergen information displayed on the Site, as this information is supplied by product manufacturers and may change without notice. Please consult the product label directly or contact the manufacturer if you have specific dietary concerns.

LakArcade is not liable for any damage or loss arising from reliance on any advertisement, linked third-party site, or related materials displayed on the Site. Linking to third-party sites is done entirely at your own risk.

Jurisdictional Issues

The Site is controlled and operated by LakArcade from Sri Lanka and is not intended to subject LakArcade to the laws or jurisdiction of any other state, country, or territory. LakArcade does not represent that the Site is appropriate for use outside Sri Lanka. If you access the Site from another location, you do so on your own initiative and are responsible for complying with local laws. We may restrict the Site's availability to any person, region, or jurisdiction at our discretion.

Limitation of Liability

Under no circumstances shall LakArcade or its employees, directors, officers, or agents be liable for any direct or indirect losses or damages arising from your use of, or inability to use, the Site. This limitation applies to all types of losses and damages, whether in contract or tort, even where LakArcade has been advised of the possibility of such damages. If you are dissatisfied with the Site or these Terms & Conditions, your sole remedy is to discontinue using the Site. Some jurisdictions do not allow such limitations, in which case this limitation may not apply to you, and you may have additional rights under local law.

Terms of Sale

By using LakArcade's products, services, and website, you agree to the following:

• Each order is valid only for the product specified.
• Island-wide delivery is available at an additional cost for specified products only.
• LakArcade management reserves the right to decide on the replacement of products that carry no warranty.
• Unless stated otherwise, orders cannot be combined with other gift certificates, vouchers, or promotions.
• Orders cannot be exchanged or redeemed for cash.

Cancellation, Return and Refund Policy

Once a confirmation of transaction has been sent by email, orders cannot be cancelled or goods returned. Any issue relating to a product or service must be reported to LakArcade within 2 days of purchase. LakArcade management reserves the exclusive right to decide on refunding or replacing a product.

Unavailability of Product / Product Out of Stock

Inventory for products advertised on LakArcade is managed by our suppliers, with LakArcade acting only as an intermediary. Products may occasionally be unavailable due to overselling by suppliers, even if still listed as available on the Site. LakArcade accepts no liability in such circumstances, and the customer's only remedy for an unavailable product is a refund of the amount paid.

Placing an order, including payment, is treated as an offer to purchase. You will receive an Order Confirmation E-mail acknowledging receipt of your order — this does not constitute acceptance of your offer. We accept your offer only once delivery has commenced after the supplier has released the product.

Refunds

All refunds are processed within 7 working days by LakArcade. Further processing time back to your card or bank account may vary depending on your financial institution, for which LakArcade cannot be held liable. You may have additional consumer rights under local law that this policy does not override.

Indemnification and Defense

As a condition of using the Site, you agree to defend, indemnify, and hold harmless LakArcade and its employees, directors, officers, agents, vendors, and suppliers from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, including any User Content you submit or any breach of these Terms & Conditions.

Miscellaneous

These Terms & Conditions, together with any policies linked from or incorporated into them, constitute the entire agreement between you and LakArcade regarding the Site, superseding any prior communications or agreements. No provision will be considered waived except in writing, and a failure to enforce any right does not constitute a waiver of that right. If any provision is found invalid or unenforceable, the remaining provisions will remain in full effect. You may not assign or transfer your rights under these Terms & Conditions without our prior written consent, and we are not responsible for failures caused by circumstances beyond our control.
